Broadcasting

Relying on the Law on Communications of Bosnia and Herzegovina, in the area of broadcasting, the Communications Regulatory Agency has conducted itself with the imperative of supporting the development of the audiovisual sector in Bosnia and Herzegovina and protecting the creative freedoms, cultural and political differences, and democratic processes, while protecting human dignity and, most importantly, developing and protecting one of the fundamental human rights, the right to freedom of expression, which is a necessary precondition for a functioning democracy.

In the field of broadcasting, the principal activities of the Communications Regulatory Agency are:

  • The introduction of professional standards in the field of radio and television broadcasting, cable distribution of radio and television programs, the digitalization of radio and television broadcasting;
  • The issuing of broadcasting licenses to electronic media, cable distributors, as well as licenses for satellite broadcasting;
  • The undertaking of activities to prevent illegal radio and television broadcasting and cable distribution of radio and television programs;
  • The management and resolution of cases regarding program standards, technical requirements for radio and television broadcasting licenses, license conditions for the cable distribution of radio and television program, and licenses for audiovisual media services, as well as timely action in reference to complaints and appeals, in cooperation with the relevant sections and divisions within the Communications Regulatory Agency;
  • The establishing of regulations in the fields of broadcasting, advertising, and other applicable rules and the proposing of applicable changes and amendments to the Broadcasting Code of Practice and other relevant rules and regulations of the Communications Regulatory Agency in case of need;
  • To represent the Communications Regulatory Agency in various working groups, projects, etc. in the field of broadcasting, as authorized by the Director General;
  • The preparation of studies, proposals, and research in terms of introducing innovations in the field of broadcasting, cable distribution of radio and television programs and the switchover to digital television;
  • The coordination of issues of broadcasting with the Council of Ministers of Bosnia and Herzegovina and other state and entity institutions, in accordance with the powers granted by the Director General;
  • To take reasonable measures to protect copyrights in the fields of broadcasting and cable distribution of program, in accordance with the relevant legal provisions;
  • Co-operation and regular contact with licensees;
  • The performing of duties assigned to it by the laws governing the work of the Public Broadcasting System of Bosnia and Herzegovina and the public broadcasting services in Bosnia and Herzegovina;
  • Harmonization of the regulatory framework in line with the European legal instruments and standards, as well as recommendations of the EU in order to advance toward European integration;
  • Cooperation with the Central Election Commission of Bosnia and Herzegovina and the implementation of relevant provisions of the Election Law of Bosnia and Herzegovina and the Rules on Media Representation of Political Subjects;
  • To represent the Communications Regulatory Agency in the relevant national and international levels in the field of broadcasting;
  • An active cooperation with the international organizations related to the work area of broadcasting, such as the European Commission, the Council of Europe et al.;
  • The analysis of events that may affect the media environment and the work of the Communications Regulatory Agency;
  • The promotion of media literacy and the raising of public awareness about the responsible and safe use of all media services.
