Broadcasting

Relying on the Law on Communications of BiH, the Agency, in the field of broadcasting, regulates and supports the development of the audiovisual sector in BiH, as well as protects creative freedom, cultural and political differences thus protecting human dignity. In its work, the Agency is dedicated to protecting the right to freedom of expression as a fundamental human right necessary for functioning of democratic processes.

In the field of broadcasting, the Agency:

  • Establishes professional standards in the field of audiovisual media services and radio media services, cable distribution and digitization of radio and television broadcasting;
  • Issues licenses to providers of media services, cable distributors, as well as permits to the public broadcasting services in Bosnia and Herzegovina;
  • Prevents illegal provision of services in the field of broadcasting;
  • Manages and resolves cases regarding program standards, technical conditions of broadcasting, license conditions for cable distribution and timely act on complaints and appeals, all in cooperation with the relevant regions and departments within the Agency;
  • Develops regulations in the field of broadcasting, advertising, and other applicable rules, as well as other relevant rules and regulations of the Agency;
  • Represents the Agency in various working groups, projects, etc., in the field of broadcasting, and under the authority of the Director General;
  • Prepares studies, proposals, and research regarding introducing innovations in the field of broadcasting, cable distribution and the transition to digital TV;
  • Coordinates the issues of broadcasting with the Council of Ministers and other state and entity institutions, by the authority given by the Director General;
  • Coordinates the issues of transition from analogue to digital terrestrial television broadcasting with the Council of Ministers and other relevant institutions;
  • In collaboration with the field of Radiofrequency Spectrum of the Agency, it determines the ways and conditions of use of the multiplex for the needs of digital terrestrial broadcasting, and carries out a public call for the allocation of rights to use the multiplex;
  • Issues licenses for digital terrestrial broadcasting;
  • By the relevant legal provisions, it takes reasonable measures to protect copyright in the field of broadcasting and cable distribution;
  • Cooperates and maintains regular contact with licensees;
  • Performs duties as set by the laws governing the operation of the Public Broadcasting System of BiH and Public Broadcasting Services in Bosnia and Herzegovina;
  • Performs harmonization of the regulatory framework in line with European legal instruments and standards, and the recommendations of the European Union with the aim of European integration;
  • Cooperates with the Central Election Commission of Bosnia and Herzegovina and implements the relevant provisions of the BiH Election Law and the Rule on media coverage of political subjects;
  • Represents the Agency to the relevant national and international levels in the field of broadcasting;
  • Actively cooperates with international organizations related to the work in the field of broadcasting, such as the European Commission, Council of Europe and others;
  • Analyzes events that may have an impact on the media environment and the work of the Agency;
  • It promotes media literacy, and works to raise public awareness about responsible and safe use of all media services;
  • Cooperates with educational institutions and participates in educational activities and lectures to clarify the principles of regulation of electronic media, mandate and working methods of the Agency to the pupils of primary and secondary schools and students of journalism and related studies.

Program standards and complaints

The main activities of the field of broadcasting regarding program standards, complaints and regulation in broadcasting include:

  • Processing and analyzing complaints and investigating cases of possible violations of rules and regulations by the established subordinate legislation procedure;
  • Managing and resolving cases regarding program standards, and timely action on complaints and appeals;
  • Production of reports on cases concerning the program content;
  • Preparation of studies, proposals, and research regarding introducing innovations in the field of program standards;
  • Activities on the harmonization of the regulatory framework in line with European legal instruments and standards, and the recommendations of the European Union with the aim of European integration, while taking into account the economic and social realities of Bosnia and Herzegovina;
  • The implementation of the relevant provisions of the BiH Election Law and the Rule on media coverage of political subjects in election processes and cooperation with the Central Election Commission of Bosnia and Herzegovina.
